Information on the processing of personal data of website users Articles 13 and 14 of Regulation 2016/679/EU (hereinafter also “GDPR”).

Why this notice

Arky Studio srl (hereinafter also referred to as the “Company” or “Data Controller”) is committed to respecting and protecting your privacy. We want you to feel secure both when simply browsing our website and when you decide to register by providing us with your personal data to use the services made available to our Users and/or Customers.  

On this page, the Company intends to provide some information on the processing of personal data concerning users who visit or consult the website accessible electronically from the address (the “Website”). This information is provided only for the Company’s website and not for other websites that may be consulted by the user through links (for which please refer to their respective privacy policies).  

The reproduction or use of pages, materials, and information contained within the Website, by any means and on any medium, is not permitted without the prior written consent of the Company. Copying and/or printing for exclusively personal and non-commercial use is permitted (for requests and clarifications, please contact the Company at the addresses indicated below). Other uses of the contents, services, and information on this site are not permitted.  

With respect to the content offered and the information provided, the Company will endeavor to keep the Site content reasonably up-to-date and reviewed, without offering any guarantee on the adequacy, accuracy or completeness of the information provided, expressly declining  any responsibility for any errors  or omissions in the information provided on the Site.

Origin of browsing data

Company informs you that the personal data you provide and that is acquired in connection with your request for information and/or contact, registration on the site and use of the services via smartphone or any other instrument used to access the Internet, as well as the data necessary for the provision of such services, 1 including browsing data and data used for any purchase of products and services offered by 2 Company, but also the so-called “browsing” data of the site by Users, will be processed in compliance with applicable law. The computer systems and software procedures used 3 to operate this website acquire, during their normal operation, some personal data whose transmission is implicit 4 in the use of the Internet. This is information that is not collected to be associated with identified interested parties, but which by its very nature could, through processing and 5 association with data held by third parties, 6 allow the identification of user browsers. This category of data includes “IP addresses” or domain names of computers used by users connecting to the site, URI (Uniform Resource Identifier) 7 addresses of the requested resources, the time of the request, the method used in submitting the request to the web server, the size of the file obtained in response, the numerical code indicating the status 8 of the response given by the web server (success, error, etc.) and other parameters related 9 to the operating system and the user’s computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of 10 the site and to check the correct functioning of the Company’s website. It should be noted that the aforementioned data could be used to ascertain responsibility 11 in case of computer crimes against the Company’s website or other sites connected or linked to it: except for this eventuality, at present the web contact data do not persist for more than a few days.

Origin - User-provided data

The Company collects, stores, and processes your personal data for the purpose of providing the products and services offered on the Website, or as required by law. For certain specific Services, Products, Promotions, etc., the Company may also process your data for marketing purposes. In such cases, specific, separate, optional, and always revocable consent will be requested using the methods and contacts indicated below.   

The optional, explicit, and voluntary sending of email to the addresses indicated in the appropriate section of the Website, as well as the completion of questionnaires (e.g., forms), communication via chat, push notifications via APP, social networks, call centers, etc., will result in the subsequent acquisition of some of your personal data, including that collected through the use of Apps and related services, necessary to respond to your requests. Please note that when using a mobile connection to access digital content and services offered directly by the Company or by our Partners, it may be necessary to transfer your personal data to these third parties. 

You may access the Website or connect to areas where you may be able to publish information using blogs or bulletin boards, communicate with others, for example, from the Company page on Facebook®, LinkedIn®, YouTube®, and other social networking sites, review products and offers, and post comments or content. Before interacting with these areas, we invite you to carefully read the General Terms of Use, bearing in mind that, in some circumstances, the information published may be viewed by anyone with Internet access and all information you include in your publications may be read, collected, and used by third parties.

Purpose of the processing

Data is processed for the following purposes:

  • Strictly necessary for: registration on www.arkystudio.it, using the services and/or Apps developed or made available by the Company, accessing related information services, managing contact or information requests, and making purchases of products and services offered through the Company’s website.
  • Ancillary activities related to: managing user/customer requests and sending responses, which may include the transmission of promotional material; completing purchase orders for products and services offered, including aspects related to credit card payments, shipping management, exercising the right to withdraw from distance contracts, and updates on the availability of temporarily unavailable products and services.
  • Compliance with: community and national regulations, safeguarding public order, and investigating and preventing crimes.
  • Direct marketing: sending advertising material, direct sales, conducting market research, or commercial communication of products and/or services offered by the Company; this activity may also concern products and services of companies within the Company Group and may be carried out through the sending of advertising/informational/promotional material and/or invitations to participate in initiatives, events, and offers designed to reward users/customers, using both “traditional” methods (e.g., paper mail and/or operator calls) and “automated” contact systems (e.g., SMS and/or MMS, telephone calls without operator intervention, email, fax, interactive applications), pursuant to art. 130 c. 1 and 2 of Legislative Decree 196/03 and subsequent amendments.  

Providing data for purposes 1), 2), and 3), related to a pre-contractual and/or contractual phase or functional to a user request or provided for by a specific legal provision, is mandatory. Failure to do so will make it impossible to receive the requested information and access the services. Regarding point 4) of this Privacy Policy, the user/customer’s consent to the processing of data is free and optional and can always be revoked without consequences on the usability of the products and services, except for the impossibility for the Company to keep users/customers updated on new initiatives or special promotions or advantages that may be available. The Company may send commercial communications regarding products and/or services similar to those already provided, pursuant to Directive 2002/58/UE, using the email or paper coordinates provided by you on those occasions, which you may oppose using the methods and contacts indicated below.

Methods, processing logic, data retention periods and security measures

The processing is carried out also with the aid of electronic or automated means and is performed by the Company and/or by third parties that the Company may use to store, manage and transmit the data. The data will be processed using organizational and processing logic of your personal data, including logs originating from the access and use of the services made available via the web, of the products and services used, related to the aforementioned purposes and, in any case, in a way to guarantee the security and confidentiality of the data. The personal data processed will be stored for the time provided by the applicable regulations. 

Always regarding data security, in the sections of the website set up for particular services, where personal data is requested from the user, the data is encrypted using a security technology called Secure Sockets Layer, abbreviated as SSL. 

SSL technology encodes the information before it is exchanged via the Internet between the user’s computer and the Company’s central systems, making it incomprehensible to unauthorized parties and thus guaranteeing the confidentiality of the information transmitted; furthermore, transactions carried out using electronic payment instruments are carried out directly using the platform of the Payment Service Provider (PSP) and the Company only retains the minimum set of information necessary to manage any disputes. 

Precisely with reference to the aspects of personal data protection, the user/customer is invited, pursuant to art. 33 of the GDPR, to report to the Company any circumstances or events from which a potential “personal data breach” may arise in order to allow an immediate assessment and the adoption of any actions aimed at counteracting such an event by sending a communication to info@arkystudio.it or by contacting Customer Service. The measures adopted by the Company do not exempt the Customer from paying the necessary attention to the use, where required, of passwords/PINs of adequate complexity, which must be updated periodically, especially if he fears that they have been violated/known by third parties, as well as to carefully guard and make them inaccessible to third parties, in order to avoid improper and unauthorized use.

A cookie is a small text file that is sent to your browser and may be stored on your computer (or your smartphone/tablet or any other device used to access the internet); this usually happens every time you visit a website. [Company Name] uses cookies for various purposes, in order to offer you a fast and secure digital experience, for example, by allowing you to keep your connection active to the protected area while browsing the site. 

The cookies stored on your device cannot be used to retrieve any data from your hard drive, transmit computer viruses or identify and use your email address. Ambiti di comunicazione e trasferimento dei dati

For the purposes outlined above, Arky Studio may communicate and have processed, both within Italy and abroad, the personal data of users/customers to third parties with whom we have relationships, where these third parties provide services at our request. We will only provide these third parties with the information necessary to perform the requested services, taking all measures to protect your personal data. Data may be transferred outside the European Economic Area if this is necessary for the management of your contractual relationship. In this case, the recipients of the data will be subject to protection and security obligations equivalent to those guaranteed by the Data Controller. In the case of using services offered directly by Partners, we will only provide the data strictly necessary for their execution. In any case, only the data necessary to pursue the intended purposes will be communicated, and, where required, the guarantees applicable to data transfers to third countries will be applied. We may also disclose your personal data to our commercial service providers, for marketing purposes, for which purpose they are appointed as external data processors. Furthermore, personal data may be communicated to the competent public authorities for the purpose of fulfilling legal obligations or for ascertaining liability in the event of cybercrime against the site, and may also be communicated to, or stored with, third parties (acting as data processors or, in the case of electronic communications service providers, as independent data controllers) who provide IT and telematic services (e.g., hosting services, website management and development) and which Arky Studio uses to perform tasks and activities of a technical and organizational nature instrumental to the operation of the website. The subjects belonging to the categories listed above operate as distinct data controllers or as data processors appointed by Arky Studio for this purpose.

Rights of the data subject

You may exercise at any time the rights granted to you by law, including the right to:

  • Access your personal data, obtaining information about the purposes pursued by the Data Controller, the categories of data involved, the recipients to whom the data may be disclosed, the applicable retention period, and the existence of automated decision-making processes;  
  • Obtain, without undue delay, the rectification of inaccurate personal data concerning you;
  • Obtain, in cases provided for, the erasure of your data;
  • Obtain the restriction of processing or to object to processing, where possible;
  • Request the portability of the data you have provided to the Company, meaning receiving it in a structured, commonly used and machine-readable format, also for the purpose of transmitting such data to another controller, within the limits and under the constraints provided for by Article 20 of the GDPR; 

Furthermore, you may lodge a complaint with the Data Protection Authority pursuant to Article 77 of the GDPR.

For the processing referred to in point 4) of the purposes, the Customer may always revoke consent and exercise the right to object to direct marketing (both “traditional” and “automated”). In the absence of any indication to the contrary, the opposition will be referred to both traditional and automated communications.
